Who is responsible when an autonomous vehicle is doing the driving and the police intend to take enforcement action for an error it commits? This question is explored in a report from the Rand Corporation. While the report looks at the perspective in the US, the same questions will have to be answered here in Canada.
This is already being considered here in BC if Twitter is any indication. Coquitlam RCMP Tweeted that autonomous speed control that caused the vehicle to exceed the speed limit was not an excuse. Criminal lawyer Paul Doroshenko responded "I say at this point itβs the same as cruise control. @IRPlawyer says not so fast..."
I wonder if there will be Motor Vehicle Act amendments to take this into account in the near future?
