CASE LAW - R v Lukas

In this case Allen Lukas appeals his conviction for speeding based on the visual observation of his vehicle's speed made by Cst. Neid of the Kelowna R.C.M.P. Detachment. The two grounds for appeal were that the Justice failed to properly guide him through the trial process and that the Justice failed to consider the distance between his vehicle and the police vehicle at the time Cst. Neid made his estimate.
