CASE LAW - Vance v Cartwright

BC Courts Coat of ArmsWilliam Vance was riding an unlicenced, uninsured off road motorcycle southbound on 198 Street in Langley, B.C. He was not wearing a helmet and was exceeding the speed limit. Cristine Cartwright was eastbound on 21 Avenue and had stopped at the stop sign before entering 198 Street intending to turn northbound. Vision was limited for drivers on 21 avenue looking northbound by roadside vegetation.

Mr. Taylor was riding a motorcycle in poor repair and Mr. Depew was driving a dune buggy on a single lane dirt forest road serving a forest service camp site near Campbell River.

My neighbours frequently use their dirt bikes to race up and down our street (drivers age from about 6 to grown adults) while other children are playing and there is traffic. Some drivers wear the protection, others not.

These vehicles are identified as vehicle type โ€˜RUMโ€™ on the Canadian Motor Vehicle Safety Standards (CMVSS) compliance label. These vehicles are manufactured and intended STRICTLY FOR OFF HIGHWAY USE and do not meet applicable standards for operation as highway vehicles.
