Major changes to the way auto insurance in BC functions took place without fanfare on May 1. According to a summary outlining the key changes on the Borden Ladner Gervais LLP web site, you will no longer be able to take legal action for most motor vehicle collision claims.
There are exceptions that apply to the following:
- vehicle and vehicle part manufacturers
- vehicle retailers
- garage service operators
- establishments licensed to serve alcohol
- drivers who cause bodily injury and are subsequently convicted of a prescribed Criminal Code offence
The exceptions are limited to non-pecuniary, punitive, exemplary or similar non-compensatory damages.
