CASE LAW - R v Tomkowicz

Robert Tomkowicz was issued a violation ticket for crossing a solid line and illegal use of an HOV lane while traveling southbound on Highway 99 in Richmond, B.C. The judicial justice in traffic court convicted him for both offences after a trial.

Mr. Tomkowicz appealed the conviction saying that the judicial justice had erred, he was able to cross the solid line in order to leave the highway and needed to use the HOV lane to safely exit onto the Steveston Highway. Mr. Justice Bowden disagreed and upheld the original convictions.
