CASE LAW - Chang v Alcuaz

The case of Chang v Alcuaz examines an intersection collision where the drivers approached each other at right angles. Both claim that they were facing a green light when they proceeded into the intersection. It is interesting to see how the judge determines which driver had actually faced a green traffic signal.

Of more interest is the explanation of case law that explains that a driver cannot blindly expect right of way when traveling through an intersection while facing a green light. If a danger is reasonably apparent, the driver must attempt to prevent a collision. Failing to do so will attract some liability.
