CASE LAW - Knight v Li

BC Courts Coat of ArmsThe case of Knight v Li examines a collision at the intersection of 41 Avenue and Angus Drive in Vancouver, B.C. Mr. Knight, with a BAC of 168 mg%, was traveling southbound on Angus Drive. Mr. Li was traveling eastbound on 41 Avenue in the curb lane. The two collided within the intersection with the front of Mr. Li's vehicle striking Mr. Knight's vehicle at approximately the front of the passenger door.

Angus Drive is controlled by stop signs and 41 Avenue is controlled by a flashing green light at this intersection

The discussion in the case examines the duties of both of these drivers to yield with regard to the stop sign. It is not always the duty of the driver leaving the stop sign to yield to cross traffic.

The flashing green light imposes a duty on Mr. Li to exercise added caution in approaching the intersection.

Finally, the issue of speed and how it contributed to the collision is examined.
