Don't Spit on Other Drivers!

BC Courts Coat of ArmsThis is an incident that occurred near Saanich starting on McKenzie Avenue near Glanford Avenue and proceeding westbound. It ended at the red light on Burnside Road near the TD Bank when one driver decided to spit on the other and the police were called.

Road Rage Begins

The situation involved a mid size pickup truck driven by Adam Gleeson and a Nissan Versa driven by Megan Kirkpatrick. It appears that Mr. Gleeson was unhappy that Ms. Kirkpatrick was holding a conversation on a cell phone that she was holding in her hand. He shook his head at her.

A series of driving moves then took place between the two drivers including each shouting at each other.

One Driver Spits on the Other 

The incident ended when Mr. Gleeson pulled up beside Ms. Kirkpatrick and spit on her. This resulted in Mr. Gleeson being charged with assault and dangerous driving.

Not Dangerous Driving

After a trial, Justice Brecknell found Mr. Gleeson not guilty of the dangerous driving charge. Crown Counsel did not lead enough evidence about other traffic present at the time. In addition if Ms. Kirkpatrick had simply pulled over and stopped much of the incident would not have happened.

There was no doubt that the defendant's driving was at times aggressive and discourteous. That type of driving may have amounted to an offence under the Motor Vehicle Act.

Mr. Gleeson was guilty of an assault for spitting on Ms. Kirkpatrick. Justice Brecknell imposed a conditional discharge that included 9 months of probation requiring no contact with Ms. Kirkpatrick.
